Terms of Service

1. The service

UptimeMonitor360 is a monitoring and reporting service provided by SEO XTRYDENT DI MARRAS CARLO GIUSEPPE. It observes publicly reachable endpoints you configure, records measurements, and sends notifications and reports. Detection and notification are not remediation: the service never changes your systems.

Measurements are observations from the probe locations actually deployed. We do not guarantee that an observation reflects the experience of every visitor, nor that incidents are detected within any fixed time.

2. Accounts and acceptable use

You must only monitor endpoints you own or are authorized to monitor. Monitoring private networks, scanning, and using the service to overload third parties is prohibited and technically restricted. See the Acceptable Use Policy.

You are responsible for the security of your credentials, including API keys and heartbeat URLs. Two-factor authentication is available on every plan.

3. Plans, billing and changes

Prices, limits and retention are those shown on the pricing page at the time of purchase and in your account. Annual plans charge ten monthly payments for twelve months of service. Prices are in EUR and are the total recurring amount shown for approval in PayPal; any applicable VAT is included. PayPal may charge currency conversion fees separately.

PayPal processes recurring payments. Plan changes require your approval in PayPal and take effect at the next billing period, without an immediate prorated charge. Cancel renewal from your billing page to stop future payments; access already paid for remains available until the recorded end of the billing period.

If a downgrade leaves your account above the new limits, nothing is deleted. Creating new monitors is blocked, and after a 14-day grace period the newest excess monitors are paused until you reduce usage or upgrade. Contact us with your payment reference for invoice or refund requests; mandatory statutory rights remain unaffected.

4. Free plan and trial

The Free plan requires no payment method. The optional 14-day Business trial is started explicitly, once per eligible account, and never converts into a charge without a separate checkout.

5. Data and retention

Raw individual check results are retained for the period of your plan; aggregated history for longer, as described on the pricing page. Billing records are retained as required by law even after account deletion.

You can export your data and request deletion from your account. Deletion completes after a 14-day grace period.

6. Availability of the service

We operate the service with care but do not offer contractual uptime guarantees, dedicated staff or guaranteed response times by default. Enterprise agreements may define additional terms individually.

7. Liability

To the extent permitted by applicable law, the service is provided without warranties of fitness for a particular purpose, and liability is limited to the fees paid in the twelve months preceding a claim. Nothing in these terms limits liability that cannot be limited by law.

8. Termination

You may cancel at any time; cancellation takes effect at the end of the paid period. We may suspend accounts that violate the Acceptable Use Policy or fail to pay, with notice where practical.

9. Governing law

These terms are governed by the laws of Italy, without prejudice to mandatory consumer protections.
